Bans on Medical Devices by FDA

A medical device ban is a complete restriction on all present and future production, distribution, and sales of medical devices if the FDA Medical Device Regulations believes that a medical device intended for human use offers a significant and unjustified risk of disease or harm, which cannot be mitigated by a modification in labeling, or materially misleads patients or users about the device’s advantages or disadvantages by FDA Medical Device Regulations

Steps taken by the FDA to prohibit medical devices.

The FDA evaluates and weighs the hazards and advantages that a device poses to humans before deciding whether to outlaw it. This analysis could consist of:

  • Locating and analyzing the device, including evaluating any negative effects
  • Examining the advantages and disadvantages of alternative medical practices use of technology and therapies
  • Determining if altering the device’s labeling would reduce the danger,
  • Considering medical literature
  • Organizing a panel discussion with outside consultants,
  • Expressing concerns to professional organizations and reviewing data from patients and healthcare providers.

The FDA only needs to determine that a device has the potential to offer the necessary degree of danger based on all relevant facts and information in order to impose a ban on it without actual proof of disease or damage.

The FDA may begin legal action to get the device banned if:

  • The device’s labeling contains significant false information or poses a significant risk of disease or harm.
