When Does China Expect Local Clinical Trials Under China Medical Device Regulations?

All applications shall undergo a scientific clinical evaluation, unless exemption can be granted on the basis of an NMPA adjusted catalogue. Exemption from clinical trials is typically granted for products that have a clearly defined mechanism of action, established design, proven manufacturing history, have a predicate device in clinical use for a considerable period of time with no serious adverse events, or have demonstrated safety through non-clinical or comparative means.

Safety must be demonstrated either through predicate comparison dossiers or local clinical trials, which must be conducted at an accredited institution in China in accordance with Good Clinical Practice (GCP) upon submission to the local provincial drug administration. Class III medical devices, considered high-risk, must be approved by the national medical products administration NMPA, can only be conducted in Tertiary A hospitals, and their approval is automatically revoked if no subjects have signed informed consent forms within three years from the start of trials.

How Long Does China NMPA Review Take?

Statutory clock begins after the acceptance for evaluation by the competent authority. The competent authority shall review the dossier within 3 working days of receipt for acceptance. The evaluation clock stops when additional information, dossier supplementation, QMS corrective actions or expert consultations are undertaken, as well as field inspections. The time limits for re-submission of applications may not exceed the period of the initial evaluation by more than 50%

Certificate Life, Changes, Fees, and Post Market Duties

Validity and renewal

Certified devices get the systematic certificate number that identifies the national jurisdiction of issuance, imported product indication, year of registration, risk classification, and product coding. Initial certificates remain valid for five years. The re-registration application should be submitted precisely six months before expiry date.

Changes

Any modifications to design, composition, production, or intended use require formal change registration. Non-substantial changes in the form of modification in registrant or domestic agent names and addresses should be registered within 30 days from the date of occurrence.

Fees and enforcement

The fee for registration is to be paid in full upon formal acceptance of application. Any failure to make payment within the specified limit will treat the application as voluntarily withdrawn. In the course of review, CMDE can ask CFDI to inspect manufacturing facilities. Production lines that have been suspended for one year or more require protocol for verification prior to restarting. Defective or non compliant distributed products trigger mandatory device recall and destruction or retrieval of inventory.

  • What are the barriers for overseas manufacturers before NMPA reviews a medical device registration in China?

  • You cannot apply for registration from overseas. You need to appoint an agent in China, and also submit a marketing authorization certificate issued by the local competent authorities (FDA, CE, etc) indicating that the product has been approved for sale in the country of origin.

  • Can I register the product in China without home country approval?

  • Only if it is an innovative medical device in China. However, you need to provide proof that the product is not considered a medical device in the country of origin (proof of authorization to sell the product as a non medical device).

  • How many days does it take for a technical review of Class II and III?

  • The initial technical review for Class II medical devices takes up to 60 days while Class III medical devices take 90 days. For an additional supplement, the time of technical review is up to 60 days for both classes. From the beginning of the technical review to the issuance of certificates, it takes another 20 days for the NMPA administrative licensing and 10 days for the issuing of certificates.

  • Do NMPA’s inspectors organize overseas visits to the manufacturer’s site?

  • Yes. At the stage of technical review, the Center for Medical Device Evaluation can ask the State Food and Drug Administration’s overseas inspection department to inspect overseas manufacturers. This is mainly done for the design, production, and verification of test reports when self testing is applied.

  • Are there any additional requirements for registering Class III IVD reagents?

  • In addition to the basic requirements, for the Product Technical Requirements, an appendix of the main raw materials and manufacturing methods should be provided. Three different lots should be tested, and the tests should be done using reference materials according to Chinese national standards, if available.

  • How long is a China Medical Device Registration certificate valid for?

  • A registration certificate is valid for 5 years from the date of issuance. The renewal application must be submitted 6 months prior to the expiry date. In case of significant changes to the registered product (design, material, manufacturing process, indication, and function), the change registration must be made. If the changes are insignificant and do not affect the essence, the registrant or agent is obliged to make the update within 30 days.

  • When is a local clinical trial necessary?

  • A clinical study is mandatory for all medical devices, except those listed in the list of exempt medical devices by the NMPA. For the rest of the medical devices, either a dossier for predicate comparison or a clinical study in compliance with china medical device regulations and Good Clinical Practices in China should be provided. Clinical studies for Class III medical devices require the consent of the NMPA and should be performed in the appropriate medical facilities.
