INTRODUCTION

Every person engaged in the specific food business of Health Supplements and Nutraceuticals whether it be manufacturing, relabelling, repacking, or importing must obtain a valid 14-Digit FSSAI License under the FOOD SAFETY AND STANDARDS ACT, 2006. While general food businesses operate on simple turnover rules, the Nutraceutical sector (Category 13.6) is governed by stricter compliance standards due to the health claims and active ingredients involved.

WHAT IS FSSAI’S ROLE IN REGULATING NUTRACEUTICALS?

FSSAI stands for Food Safety and Standards Authority of India. The authority was established under the Food Safety and Standards Act, 2006 to monitor, govern, and lay standards for food business operators (FBOs) in India.

For the Nutraceutical industry, FSSAI plays a critical role in differentiating between “Food” and “Drug.” It ensures that products sold as Health Supplements, Nutraceuticals, Food for Special Dietary Use, and Functional Foods are safe for consumption and do not make false curative claims. MANDATORY FSSAI REGISTRATION FOR HEALTH SUPPLEMENTS & FUNCTIONAL FOODS

It is mandatory for eligible food business operators like Manufacturers, Relabellers (Brand Owners), Importers, and Marketers of nutraceuticals to obtain a License. Unlike a local kirana store, a nutraceutical business cannot operate without a valid license number printed on the label.

WHO IS EXEMPT FROM FSSAI REGISTRATION?

Are there exemptions? Generally, No. While the FSS Act exempts “petty manufacturers” (like hawkers or temporary stall holders), the nature of Nutraceutical manufacturing requires a controlled environment, hygiene standards, and testing protocols that “petty” setups cannot meet. Therefore, virtually every serious Nutraceutical business requires a formal License, not just a registration.

VALIDITY OF FSSAI REGISTRATION/ LICENSE

A License granted under the Act shall be valid and subsist for a period of minimum 1 year and maximum 5 years at one time. The right to choose the validity period lies with the Food Business Operator.

The License can be renewed for a further period of 1 to 5 years by filing an application on the FoSCoS Portal not later than 30 days prior to the expiry date.

VALIDITY PERIOD AND RENEWAL OF FSSAI NUTRACEUTICAL LICENSES

The fee structure varies based on the license type chosen on the FoSCoS portal. For Nutraceuticals, since most businesses fall under State or Central categories, the fees are higher than standard food registration.

STEP-BY-STEP GUIDE TO FSSAI REGISTRATION FOR NUTRACEUTICALS ON FOSCOS

The old FLRS system has been replaced by the Food Safety Compliance System (FoSCoS). Here is the decoded process for Nutraceuticals:

STEP 1: Log in to the FoSCoS Portal. 

STEP 2: Select the State where the premise is located. 

STEP 3: Select “Kind of Business” (KoB).

  • Manufacturer: If you own the factory.

  • Relabeller: If you own the brand but outsource manufacturing.

  • Importer: If you bring supplements from outside India.

STEP 4: Choose the correct Food Category. You must select Category 13 (Foodstuffs intended for particular nutritional uses), specifically 13.6 (Nutraceuticals).

STEP 5: Upload Mandatory Documents. For Nutraceuticals, the scrutiny is high. You must provide:

  • Form B (filled online).

  • Blueprint/Layout Plan of the processing unit (Crucial for Manufacturers).

  • Recall Plan: A mandatory document detailing how you will recall defective batches.

  • Water Analysis Report from an NABL accredited lab.

  • List of Directors/Partners with contact details.

  • NOC from Manufacturer (if you are a Relabeller).

STEP 6: Scrutiny by the Designated Officer (DO). They will check if your ingredients are permitted under the FSSAI Nutraceutical Regulations, 2016.

STEP 7: Issuance of License. If all documents are correct and the query (if any) is answered, the 14-digit license number is generated.

DECODING THE 14-DIGIT FSSAI LICENSE NUMBER

Each of the 14 digits in your FSSAI license number has a meaning:

  1. First Digit: Denotes the status. “1” means License (State/Central), “2” means Registration.

  2. Second & Third Digit: State Code (e.g., “00” for Central License).

  3. Fourth & Fifth Digit: Year of incorporation (e.g., “24” for 2024).

  4. Sixth to Eighth Digit: Registrar/Designated Officer Code.

  5. Ninth to Fourteenth Digit: Serial Number of the FBO.

MANDATORY COLOR CODES FOR NUTRACEUTICAL MANUFACTURING UNITS

FSSAI has introduced Food Safety Display Boards (FSDBs). Every nutraceutical business operator is mandatorily required to display these boards at their premises.

  1. Purple/Grey Board: Usually assigned for Manufacturing/Processing units.

  2. Green Board: For Retailers (e.g., supplement stores).

These boards provide information on food safety and hygiene practices to be followed by the FBO and display the FSSAI License number for customer verification.
